The Trust Deed

The actual formation of the Trust occurs when you have decided on who will be the parties included as Settlors, Trustees, Beneficiaries, and Appointors. A Trust Deed is then draw up and signed by the parties which details how the Trust is to function, how decisions are going to be made, and what the Trustees can legally do in accordance with the Trust Deed.

Although Trusts can exist without any specific written documentation, a standard Family Trust structure would have a Trust Deed, along with all the other incidental documents that go into forming the Trust.
